2 men claim self-defense in murder hearing | News
HUNTSVILLE, AL (WAFF)- Two men charged with murder said it was all a
case of self-defense. Thomas Wayne Martin and Jamie King both appeared for
preliminary hearings in Madison County on Wednesday. Both men are charged in
the July 18 killing of Joseph Michael Atkinson.
A Huntsville Police investigator testified
Thomas Martin saw the victim arrive at Martin's girlfriend's house. The
investigator said Martin then hit the victim with an axe handle and a fight
The investigator testified Jamie Harris King
then intervened and choked the victim until he passed out. An autopsy showed
the victim's cause of death was asphyxiation. Atkinson was transported to
Huntsville Hospital, where he later died. Both men turned themselves in to
police after the death.
King and Martin said nothing to reporters after
leaving the Madison Co. courtroom. However, Martin's attorney did, and defended
his client's actions.
"We expect that at trial, if it goes that
far, Thomas Wayne Martin was attacking in self-defense. He was actually running
from the victim when the fight started and he'll be exonerated in the long run,"
defense attorney James Foley said.
The case is bound over to a Madison Co. grand
jury. It could take months before the grand jury hears it.
